Brev Terms of Use

Section I. General Provisions
§ 1 – Definitions
- "Order Form" – The medium by which the parties agree to Customer's purchase of this Cloud Service, including the website interface where plans are selected.
- "Agreement" – An Order Form and documents incorporated into it, including these Terms & Conditions.
- "Authorized User" – Any individual authorized by Customer to use the Cloud Service, including employees, agents, contractors, or representatives of Customer or its Affiliates.
- "Cloud Service" – Any distinct, subscription-based, hosted, supported, and operated on-demand solution provided by Brev.
- "Cloud Materials" – Any non-personal data materials provided or developed by Brev during performance of the Agreement, including analytics and support materials.
- "Brev" – The Cloud Service delivered by Brev as described in the Order Form.
- "Confidential Information" – All information marked as confidential or reasonably understood to be confidential at time of disclosure.
- "Customer" – The customer named in the Order Form.
- "Customer Data" – Any data entered into or derived from the use of the Cloud Service by Authorized Users (e.g., email content, thread history).
- "Documentation" – Brev's current technical and functional documentation relevant to the Cloud Services.
- "Google Services" – Google products that Brev integrates with, including Gmail™.
- "GDPR" – EU Regulation 2016/679 on personal data protection.
Section II. Usage Rights and Restrictions
§ 2 – Usage Terms
Grant of Rights
Brev grants Customer a non-exclusive, non-transferable right to use the Cloud Service, Cloud Materials, and Documentation for internal business use only.
Authorized Users
Credentials may not be shared but may be reassigned if the original user no longer requires access.
Acceptable Use Policy – Customer may not:
- Copy, reverse engineer, or create derivative works from the Cloud Service
- Send spam or malicious content
- Violate Gmail™'s API usage limits
- Access the service through unauthorized means
- Remove Brev's copyright or authorship
- Collect/process sensitive data without legal basis
- Share credentials among users
Service Limits
- Gmail™ API limits apply
- Brev may enforce additional usage limits for stability
- Beta features may have restrictions
Section III. Brev Responsibilities
§ 3 – Service Commitments
Provisioning
Brev provides access and documentation per the Agreement.
Support
Support is provided as described in product documentation or on the Brev website.
Security
- Technical and organizational measures to protect Customer Data
- Governed by our Data Processing Agreement (DPA)
- Secure Google Services integration
Service Levels
- Target: 99.9% uptime for core services
- Maintenance windows will be announced
- No service level guarantees for beta features
Section IV. Customer Data and Privacy
§ 4 – Data Terms
Customer Data
- Customer retains all rights
- Responsible for accuracy and legality
- Must obtain email access/processing consents
Google Services Integration
- Customer must authorize access
- Retains control of permissions
- Brev accesses only minimal required data
Data Retention
- Data retention per plan
- Deleted within 90 days after termination
- Early deletion by request
Section V. Service Contract
§ 5 – Plans & Payments
Service Plans
- Free Tier: Basic access at no cost
- Pro Plan: Premium features by subscription
- Enterprise Plan: Custom organizational solutions
Beta Period
- Features/pricing subject to change
- No guaranteed duration
- Paid plans announced in advance
Payment Terms
- Secure provider processing
- Monthly or annual billing
- No refunds for partial use
Section VI. Term and Termination
§ 6 – Termination Terms
Term
Effective until terminated.
Termination
- Customer may terminate anytime
- Brev may terminate for material breach (30 days' notice)
- Immediate termination for illegal/security violations
Effect of Termination
- Access ends immediately
- Data exportable for 90 days
- Prepaid fees refunded pro-rata
Section VII. Warranties and Liability
§ 7 – Limits
Limited Warranty
- Provided "as is" during beta
- No warranty for uninterrupted service
- Brev will make reasonable efforts to maintain quality
Limitation of Liability
- Only direct damages covered
- Capped at fees paid in past 12 months
- No liability for third-party tools or force majeure
Section VIII. Governing Law
§ 8 – Legal Jurisdiction
This Agreement is governed by Swedish law.
All disputes shall be resolved by Stockholm District Court as the court of first instance.
